Please read the following Terms and Conditions carefully. By accessing our website, applications, or any other service channels, you agree to be bound by these Terms.

1Service Channels and Services

Tathep Technology Co., Ltd. and its affiliates (the “Company”) own and operate www.tathep.com, applications, and other service channels (collectively, the “Service Channels”).

The Service enables advertising on LED billboards according to formats and details you select for speed, convenience, and suitability.


2Acceptance of Terms

Your use of the Service Channels constitutes acknowledgment and acceptance of all Terms. If you do not accept or cannot comply, you may not use or access any content.

The Company reserves the right to modify Terms, policies, or guidelines at any time at its sole discretion, effective upon announcement on the Service Channels.


3Registration and User Accounts

The Company reserves the right to allow only users who register and create an account through the service channels specified by the Company to place orders, use services, and participate in activities provided on the service channels (e.g., placing orders).

By agreeing to create an account, you are deemed to agree to the following:

  • Each user may register and create only one account.
  • You agree to provide information that is accurate, truthful, and up to date.
  • You will keep your information current on a regular basis.
  • You will safeguard your account by keeping your username and password confidential and by restricting third parties from accessing your account and your computer.
  • You will notify the website and the Company immediately if you suspect any security breach related to your account.
  • You agree to be responsible for all actions taken through the use of your account and accept all risks that may arise from any unauthorized access to your account.
  • For online members under 20 years of age, any financial transactions (such as placing online orders) should be reviewed under the supervision of a legal guardian, and you should ensure that your guardian understands the mobile application’s terms and conditions.

The Company reserves the right, at its sole discretion, to revoke your account immediately without prior notice if any of the following actions are found:

  • You provided false information during registration, including failing to update the information to keep it current.
  • Access to your account by another person is detected.
  • Any action taken through your account that violates the Terms of Service or other conditions set by the Company.
  • Any action taken through your account that is unlawful or contrary to public morals, or any use with fraudulent intent.

4Fees and Payment

Fees are as determined by the Company and must be paid in advance via card charge or bank transfer. You are responsible for transaction fees.

Where applicable taxes apply, you must pay such taxes in addition to the service fees.

The Company may adjust fees and conditions at its discretion.


5Service Period

Ad publication periods follow your selected plan and are effective only after full payment.


6User Responsibilities

You warrant that your content and landing channels do not infringe third-party rights, violate laws or morality, mislead users, or contain malware/viruses.

  • No infringement of copyrights/industrial property/reputation/privacy
  • No violation of applicable laws/regulations
  • Information accurate, up-to-date, non-misleading; no viruses
  • No broken/invalid links
  • Not illegal or contrary to public order/morality

You must handle any third-party claims at your own cost and indemnify the Company for damages arising therefrom.


7Content Screening

The Company will review the submitted content for conformity with the content warranties you provide for advertising. The submitted content will not be published until both the content and the designated channels have passed the Company’s screening. If, after approval, there is any change—whether in whole or in part—to the content, the format of the content, or the designated channels, the content and the designated channels must undergo the Company’s screening again. Such screening does not constitute any warranty as to legality, safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or freedom from any defects (whether actual defects or defects in law), including without limitation safety-related defects, errors or bugs, or any infringement of rights in or relating to the submitted content or the content of the designated channels. You remain responsible for the submitted content and the designated channels.


8Suspension of Advertisement Publication

After the Company has conducted screening of the content and the format of the submitted content and the designated channels,

  • If it appears that you fail to comply with any warranty or requirement set forth in these Terms of Use, or if the Company determines that there is a possibility of such violation occurring, or
  • If the submitted content or the designated channels, as advertising media, are deemed inappropriate at the Company’s discretion due to social factors, even after the commencement of advertisement publication relating to the submitted content, the Company may immediately suspend the publication of the advertisement in whole or in part at its sole discretion, without being liable for any default, damages, or other legal liabilities to you. In such case, you will not be exempt from paying the service fees incurred and related to the submitted content.

9Service Interruptions

The Company may temporarily suspend all or part of the services in the event of any of the following:

  • Maintenance of systems or equipment used for the services;
  • Failure of systems or equipment used for the services; or
  • Inability to use telecommunications services for any reason caused by the telecommunications provider;
  • Force majeure events such as fire, power outage, natural disasters, or disruptions of networks or systems.

10Suspension of Services

The Company may immediately suspend your use of the Services without any prior notice in the event of any of the following:

  • You fail to pay the service fees or pay them incompletely.
  • You allow another person to use your account.
  • You infringe upon the industrial property rights, copyrights, or any other intellectual property rights of others.
  • You violate any laws or regulations applicable to the use of the Services.
  • You provide false, untrue, or intentionally misleading information in the application form.
  • You disseminate false or fraudulent information.
  • You disseminate information that violates the advertising publication guidelines.
  • You provide or resell advertisement placements from the Services to third parties.
  • You disseminate information unrelated or irrelevant to your products or services (or, in the case of an advertising agency, unrelated or irrelevant to the products or services of the advertiser who engaged you), or information that may direct users to unrelated or irrelevant designated channels.
  • You engage in acts that cause disadvantage or damage to the Company or its clients.
  • You engage in acts deemed unlawful or inappropriate by the Company.
  • You engage in acts that have, or are deemed by the Company to potentially have, a material disruptive effect on the Company’s business, the Services, or any operations of the Services.

11Termination of Services

  • The Company may terminate all or part of the Services at its discretion.
  • In the event the Company terminates the Services, the Company must notify you at least 45 days in advance by announcement on the Company’s website, through its system, or by written notice, which may include notice by email; or
  • If all or part of the Services are terminated under the preceding two clauses, the service agreement shall simultaneously terminate on the date such Services are discontinued.

12Data Management

  • The Company will use personally identifiable information obtained from you for the purpose of providing services, managing administration, fulfilling the terms and conditions of the Services, and complying with applicable laws or regulations, as stated in the Privacy Policy.
  • The Company will use or disclose information only for the purposes for which it was collected, unless your consent is obtained or as required by law or applicable regulations. The Company will retain your information only for as long as necessary for the above purposes.
  • The Company will receive and retain information relating to your advertising data (excluding personally identifiable information) for the purposes of data processing, statistics, or other non-commercial purposes, without charge and without limitation of time.

13Indemnification and Limitations of Company Liability

  • In the event the Company suffers damages due to your violation of these Terms of Use, you shall immediately indemnify the Company for all such damages (including any other expenses incurred by the Company).
  • In the event you receive any claims, accusations, requests, demands, or petitions, etc., that you have infringed upon the rights of a third party, including service users, relating to the Services, you shall settle such claims at your own expense and responsibility. In the event the Company suffers damages as a result of such claims, you shall indemnify the Company immediately. If the Company settles the claims, you shall pay all the costs incurred by the Company in settling the claims.
  • The Company will not be liable for any damages that may occur to you during service interruptions or suspensions due to force majeure events such as fire, power outages, natural disasters, network or system failures, or events as mentioned in Sections 9 and 10.
  • You acknowledge and agree that, in certain cases where you connect service users through the Services to external services, those external services may not be available to service users due to technical reasons or other factors. Additionally, you may incur disadvantages, including but not limited to complaints from users and/or unfair treatment from platform providers (collectively referred to as 'disadvantages'). You accept the risks associated with these disadvantages and acknowledge that connecting users to external services is at your own risk. You agree that the Company will not be responsible for any loss or damage arising from the unavailability of external services or the disadvantages.
  • Under the provisions of these Terms of Use, the Company will only indemnify you for damages caused by the Company’s willful misconduct or gross negligence, and only for direct, foreseeable damages. The indemnification amount will not exceed the actual service fees paid by you to the Company.

14Intellectual Property Rights

All content displayed on the website and mobile application is protected by intellectual property laws, owned by the Company or third parties who have granted the Company permission to use such content. You may only use such content for personal use in connection with the website. Reproduction of such content for other purposes is prohibited.

The Company explicitly reserves all intellectual property rights in all original works on the website and mobile application, including content, logos, text, graphics, design, and all information. You agree not to reproduce, download, distribute, or publish any part of the website except for personal use. You are prohibited from reproducing any part of the website in any form unless authorized in writing by the Company. The Company will not be responsible for any errors in content arising from copyright violations or damages resulting from user use. Users are prohibited from uploading to change or modify any content or parts of the website or mobile application without written consent from the Company. Violators shall be liable for their actions. All content and information published through the website and mobile application remain the property of the Company, without any possibility of reclamation for any reason, exception, or legal defense. The Company may take any actions related to such content and information. Users accept that the Company has the right to modify, update, reproduce, publish, and distribute the content and information provided by users on the website and mobile application.


Severability

If any provision is unlawful or unenforceable, it shall be severed without affecting the validity and enforceability of the remaining provisions.
